SCC award enforced in Italy
The Rome Court of Appeal recently granted enforcement of an SCC award, declaring the award enforceable in Italy.
The Republic of Kazakhstan challenged the arbitral award claiming the investors had violated the Swedish ordre public by knowingly misleading the arbitral tribunal, withholding relevant information, and presenting false evidence. Kazakhstan also claimed that the award was not covered by a valid arbitration agreement and that the tribunal had been appointed in violation of the SCC Rules.
Having reviewed Kazakhstan’s claims, the Rome Court of Appeal concluded that they were unfounded, dismissed the parties’ objections and granted enforcement of the SCC award.
