SCC Practice Note: Challenges to arbitrators 2016-2018
A recently published SCC Practice Note summarizes decisions on challenges to arbitrators made by the SCC Board during 2016-2018.
In this period around 550 new proceedings were initiated at the SCC, and more than forty challenges were filed. The Note reviews 22 challenges dismissed by the Board, and 7 challenges that were sustained. Some of the summaries of decisions made after 1 January 2018, when a new SCC policy went into effect, include excerpts of the Board's reasoning.
Written by SCC legal counsel Anja Ipp and SCC interns Rodrigo Carè and Valeryia Dubeshka, the Practice Note also discusses the standard for arbitrator impartiality in SCC arbitrations and explains the procedure for challenges to arbitrators.
