A year with SCC Platform
SCC Platform is celebrating its first birthday. For a year now, all case communication has taken place on the platform. Thanks to our tailored case management platform the SCC can offer faster, more transparent and secure handling of cases for parties and arbitrators.
In September 2019, the SCC launched - as one of the first larger arbitration institutes in the world - a digital platform for handling the case process from the request for arbitration to the award. Up to this day 230 cases have been registered on the platform out of which 73 cases have been concluded fully on the platform. More than 2700 case participants have used the platform, and 150-200 users log on to the platform every day to access case material. To date, 36 Gb and roughly 300 000 pages are uploaded in total.
– The SCC’s two main goals with the development of the platform were to simplify and streamline the process for parties and counsel and to increase security in case communication. However, we didn’t anticipate how timely the release of this new digital tool would be. Thanks to the fact that we had the platform in place, our operations have continued more or less as usual during the pandemic, says Lise Alm, Head of Business Development at SCC
Upon receipt of a request for arbitration, all SCC administrated cases are allocated its own individual “site” on the SCC Platform to which only the participants in the arbitration will be invited and provided with access. Access to the platform is included in the administration fee. The SCC Platform allows the participants to communicate and file all case materials in the arbitration online, such as procedural orders, submissions and exhibits. The platform constitutes the forum through which the SCC communicates with the parties, counsel and arbitrators throughout the proceedings. The SCC further encourages the parties to use the platform not just for the communication with the SCC, but also between the parties and the tribunal. A year later, it is clear that most parties have made use of that possibility and do uses the platform for all case communication.
– The Platform is a work in progress and we have and will add functionality to it. Since it launched, we have added the ability to further tailor the folder structure, the functionality that all material are OCR:ed upon upload and we have partnered with ExhibitManager to enable eBriefs on the platform. We will continue to add functionality as we develop an highly appreciate feedback and input from the users on what could increase the user experience further. As for the immediate future, a large project is underway relating to the internal administration. This will be less visible to the user but will increase our efficiency and allow us to continue to evolve the operations of the SCC.
During the year, the SCC also launched the Ad Hoc Platform, which is a version of the SCC Platform, but for ad hoc cases. The Ad Hoc Platform is a joint initiative by the SCC and HighQ (part of Thomson Reuters) to support the online administration of proceedings globally. Use of the Ad Hoc Platform will be free of charge from start to finish of the arbitration for arbitrations commenced during the COVID-19 outbreak. Unlike the SCC Platform, the arbitration does not need to have any connection to the SCC to use the Ad Hoc Platform and using the platform does not entail any administration by the SCC or that the arbitration is governed by the SCC Arbitration Rules. The SCC Platform Guidelines and the Ad Hoc Platform Guidelines instruct participants in arbitrations on the use of the platforms and address some of the questions that may arise along the way.
The SCC Platform and the Ad Hoc Platform are secure digital platforms for communication and file sharing between the parties and the tribunal in an arbitration. The SCC Platform is used in all SCC cases since 2019, and during 2020 as a response to the Covid-19 pandemic our additional service, the Ad Hoc Platform, is offered to all ad hoc cases upon request.
