SCC investment arbitration in the OHADA Area
The settlement of investment disputes by arbitration and mediation in the OHADA Area was at the forefront of discussion at the recent colloquium hosted by the Association for the Promotion of Arbitration in Africa (APAA) in Douala, Cameroun.
The colloquium saw a wide representation from the entire OHADA region, and included a presentation of the SCC experience of administering investment disputes.
The Organisation for the Harmonization of Business Law in Africa (OHADA), with seventeen member states in Africa, was one of the supporters of the colloquium, together with among others the United Nations Commission on International Trade Law (UNCITRAL) and the African Legal Support Facility (ALSF).
Topics address included the OHADA Uniform Act on Arbitration, Mediation in the OHADA space and, and the African Continental Free Trade Agreement (AfCFTA).
The importance of training in the settlement of investment disputes in particular, and in ADR in general, was another area of discussion.
SCC Secretary General Annette Magnusson talked about SCC investment arbitration, including on the participation of parties within the OHADA region.
